- Can NRIs and OCIs buy property in India?
- Eligible NRIs and OCIs may generally purchase residential and commercial property in India, subject to applicable law. Agricultural land, plantation property and farmhouses remain restricted categories.
- How should payment be made?
- Consideration should be paid through permitted banking channels. Depending on the case, this may include inward remittance or funds held in NRE, NRO or FCNR(B) accounts.
- Can property be purchased jointly?
- Joint purchase with another eligible person is often possible, subject to the documents of the transaction and applicable rules. AVHL can coordinate the enquiry; title and eligibility remain a matter for independent advice.
- What documents are typically required?
- A first conversation usually needs identity and overseas-status documents, together with KYC as required for the transaction. Exact requirements depend on the project and the purchaser’s status.
- Can the process begin from overseas?
- Preliminary information, availability and coordination can begin remotely. Execution of documents, payments and any inspection follow the requirements of the specific transaction.
- Can sale proceeds be repatriated?
- Repatriation, where available, is subject to applicable FEMA, RBI and tax conditions at the time. It should not be assumed from this website.
